Purpose

This website (the "Site") is operated by Villa Chris House Watamu, based at Jacaranda Street, Plot No. 1119, Kilifi/Jimba, Watamu, Kenya, and is intended to present the private villa Villa Chris House Watamu and its rooms, and to allow visitors to request information or submit a booking request. Use of the Site implies acceptance of these Terms & Conditions.

How a Booking Request Works

The Site does not have an automatic booking engine or an online payment system. Every stay request is handled as follows:

1. The guest submits a request through the Site's contact form, or directly via WhatsApp or email, indicating the desired dates, the number of guests and any other useful information.
2. The property checks the actual availability of the villa or the requested rooms and replies to the guest, typically by email or WhatsApp, with details on prices, terms and availability.
3. The booking is considered confirmed only after an explicit, manual response from the property (for example by email or message), which may set out any deposit or payment arrangements agreed separately with the guest.

Until such explicit confirmation, no request submitted through the Site constitutes a binding booking or guarantees the availability of the villa on the requested dates.

Accuracy of Published Information

The property undertakes to keep the information on the Site up to date (descriptions, photos, indicative prices, availability); however, such content is purely indicative and does not constitute a binding contractual offer. Prices, availability and final terms must always be confirmed directly with the property before being considered valid.

Limitation of Liability

To the extent permitted by applicable law, Villa Chris House Watamu shall not be held liable for any inaccuracies, delays or interruptions in the operation of the Site, nor for direct or indirect damages arising from use of the Site or the inability to use it, except in cases of wilful misconduct or gross negligence. The property does not guarantee that the Site is free of errors or always available.

Intellectual Property

Text, images, graphics, logos and any other content on the Site are the property of Villa Chris House Watamu or are used with appropriate authorisation, and are protected under applicable intellectual property law. Reproduction, copying or distribution of the Site's content without the property's prior written authorisation is prohibited.

Applicable Law

Given that the business is based in Kenya, these Terms & Conditions are in principle governed by Kenyan law, without prejudice to any mandatory consumer-protection rules provided for by the law of the guest's country of residence (for example, for guests resident in the European Union). This indication is provided for purely informational purposes: it is recommended that it be confirmed by a lawyer qualified in the Kenyan jurisdiction before being considered final.
